Article 1 – Introduction and Acceptance

This website is operated by COZIYA OUTDOOR, a Limited Liability Company registered in the State of Wyoming (United States). The terms "we," "our," and "us" refer to COZIYA OUTDOOR, publisher and operator of the website https://coziya-outdoor.com.

By accessing this site and/or placing an order, you agree to be bound by these Terms and Conditions of Sale, as well as by any additional policy published on the site. If you do not accept these terms, please do not use our site or purchase our products.

Article 2 – Purpose

These Terms and Conditions of Sale define the rights and obligations of the parties in connection with the distance selling of products marketed by COZIYA OUTDOOR LLC on the website https://coziya-outdoor.com. They apply to any order placed on the site, regardless of the nature or type of products ordered.

Article 3 – Product Catalog

COZIYA OUTDOOR LLC offers for sale a catalog of outdoor and lifestyle products that may evolve regularly with the addition of new products. Available products are those presented on the site at the time of ordering, subject to stock availability.

The essential characteristics of the products (dimensions, materials, weight, capacity, instructions for use) are described on each product page. This information is provided for guidance purposes and may be updated without prior notice to reflect changes to the catalog.

It is the customer's responsibility to follow the precautions for use and recommendations indicated on each product sheet. Any use that does not comply with the instructions provided excludes COZIYA OUTDOOR's liability.

Article 4 – Orders

Orders placed on the site are subject to validation. COZIYA OUTDOOR reserves the right to refuse any order that is suspicious, incomplete, or that does not comply with these Terms and Conditions of Sale.

The customer agrees to provide accurate and complete information when placing an order (contact details, delivery address, etc.). Any error or omission may result in delays or additional costs for which the customer will be solely responsible.

A confirmation e-mail is sent to the customer after the order is validated. The sale is deemed concluded upon receipt of this e-mail.

Article 5 – Price and Payment

Product prices are displayed in the visitor's browser currency, all taxes included. Applicable delivery charges are shown before final order confirmation.

We accept the following payment methods: credit/debit card (Visa, Mastercard, etc.), PayPal, and any other secure payment system indicated on the site at the time of ordering. All transactions are processed via secure platforms.

Article 6 – Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, you have a period of 30 calendar days from the day on which you, or a third party other than the carrier and designated by you, take physical possession of the goods, to exercise your right of withdrawal, without having to justify your reasons or pay any penalty. This period exceeds the 14-day legal minimum and is granted to you on a commercial basis.

To exercise this right, you must notify us of your decision by means of an unambiguous statement (for example, by e-mail to contact@coziya-outdoor.com, or by post to the address indicated at the end of these Terms and Conditions of Sale). You may use the model withdrawal form below, but this is not mandatory. To meet the deadline, it is sufficient that you send your communication before the withdrawal period expires.

You may also exercise this right directly online on our website, in two ways: by clicking the "Withdrawal" link at the bottom of our website (in the footer), or by going directly to your customer account by clicking the small profile icon in the menu at the top right of our website. Once logged into your customer account with the e-mail address used when placing your order, you will be able to select the relevant order, then click "Return items" or "Cancel or return," depending on the status of your order. After selecting the product(s) concerned and confirming your request, an acknowledgment of receipt is sent to you by e-mail without delay.

Effects of withdrawal. In the event of withdrawal, we will refund all payments received from you, including standard delivery charges (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method we offer), without undue delay and at the latest within 14 days from the day on which we are informed of your decision to withdraw. We may, however, withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest. Reimbursement will be made using the same payment method as used for the initial transaction, unless you expressly agree otherwise; in any event, this reimbursement will not incur any fees for you.

Products must be returned within 14 days of communicating your decision to withdraw, in their original condition (undamaged, complete, and in their original packaging where possible). You will be responsible for the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods.

Certain products are excluded from the right of withdrawal in accordance with the law, in particular personalized products and sealed products which, for hygiene or health protection reasons, cannot be returned once opened.

You are not required to use it as is: you are free to write us a personalized message to inform us of your withdrawal. Article 7 – Legal and Commercial Warranty

Our products are covered by a 2-year commercial warranty against manufacturing defects, from the date of purchase, in addition to the mandatory legal guarantees described below.

Legal Guarantee of Conformity and Guarantee Against Hidden Defects

The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity should a lack of conformity appear. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods. It entitles the consumer to have the goods repaired or replaced within 30 days of their request, at no cost and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee. If the consumer requests repair but the seller imposes a replacement instead, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if: the professional refuses to repair or replace the goods; the repair or replacement takes place more than 30 days after the request; the repair or replacement causes major inconvenience to the consumer; or the lack of conformity persists despite an unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract, without first having to request repair or replacement of the goods, when the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered. These rights arise from Articles L.217-1 to L.217-32 of the French Consumer Code.

The consumer also benefits from the legal guarantee against hidden defects, pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.

  • Material defects directly related to manufacturing.
  • Structural defects appearing under normal conditions of use.
  • Malfunctions resulting from a design or assembly defect.

COZIYA Commercial Warranty — Exclusions

  • Damage caused by use that does not comply with the recommendations.
  • Normal wear and tear related to use (fading, fabric wear, etc.), accidents, impacts, falls, or malicious acts.
  • Prolonged exposure to extreme conditions (excessive heat, freezing temperatures, humidity, prolonged UV exposure, chemical products).
  • Use of the product on an unsuitable or abrasive surface likely to damage the product.
  • Contact with a sharp, pointed, or abrasive object likely to cut, puncture, or damage the product (broken glass, needles, staples, tools, animal claws, etc.).
  • Repair, disassembly, or modification carried out by the customer or by an unauthorized third party.

Article 8 – Consumer Mediation

In accordance with the provisions of the French Consumer Code regarding the consumer dispute mediation process, after contacting us in writing and in the absence of a satisfactory response on our part, you have the option of using a free consumer mediation procedure with:

Article 9 – Customer Reviews

In accordance with Article L.111-7-2 of the French Consumer Code, COZIYA OUTDOOR informs you of the methods used for publishing and processing customer reviews appearing on the site.

Published reviews come from customers who have purchased our products, from site visitors, or may be imported from an external source; the origin of each review is indicated on it. The date of the relevant consumer experience is displayed next to the review.

Some customers who have added a photo or video to their review may receive a discount toward a future purchase, which is then specified on the relevant review. Other than in this case, no consideration is provided in exchange for submitting a review.

Reviews are kept and published for an indefinite period, unless you request their removal or we withdraw them on our own initiative in the event of non-compliance with our publication guidelines.

Article 10 – Intellectual Property

All elements present on the site (text, images, logos, designs, videos, graphics) are the exclusive property of COZIYA OUTDOOR and are protected by intellectual property laws. Any unauthorized reproduction, modification, or use is strictly prohibited.

Article 11 – Personal Data

Your personal information is collected and processed in accordance with our Privacy Policy, available on our site. By placing an order, you consent to this processing.

Article 12 – Limitation of Liability

COZIYA OUTDOOR shall not be held liable for direct or indirect damages resulting from improper use of its products, user negligence, or circumstances beyond its control (force majeure, strikes, natural disasters, etc.).

This limitation shall not, however, affect the consumer's rights of public policy, in particular under the legal guarantee of conformity, the guarantee against hidden defects, and the professional's liability in the event of gross negligence, fraud, or harm to life or physical integrity.

Article 13 – Complaints and Applicable Law

Any complaint must be sent by e-mail to contact@coziya-outdoor.com. We undertake to handle any complaint within 48 business hours.

These Terms and Conditions of Sale are governed according to the following rules:

  • For consumers residing in the European Union or the United Kingdom: these Terms and Conditions of Sale are governed by French law. In the event of a dispute not resolved amicably or through mediation, the competent courts of Nice (France) shall have exclusive jurisdiction, unless mandatory legal provisions applicable in the consumer's country of residence provide otherwise.
  • For consumers residing outside the European Union and outside the United Kingdom: these Terms and Conditions of Sale are governed by the laws of the State of Wyoming (United States). Any dispute shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Wyoming. In all cases, the mandatory provisions of the law of the consumer's country of residence remain applicable where they provide greater protection.

Article 14 – Modification of the Terms and Conditions of Sale

COZIYA OUTDOOR reserves the right to modify these Terms and Conditions of Sale at any time. Changes take effect as soon as they are published on the site.
